Hello All,
I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .
My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?

My friends h1b got rejected 2years back , he once again applied for new one in this fin year from diffrent company , does old petion will effect the new one, as he not shown th eold one while filing the new one

Hi,
I need to get my H1B stamped in Mexico. I know there are some agencies which offer a complete package trip to the Mexico US Consulate. Does anybody know some names and contact information?
I am based in Los Angeles and am pretty close to Mexico border. Do they have something in Southern California? Other places are also Ok.

My spouse H4 extension was filed in Jan 2011 and I was under impression that receipt is with lawyer. But recently I came to know that it should come to my address, as of today we have not got receipt no. I am still waiting for H1 approval decision and know H1 receipt no.
Is there way for us or our lawyer to get receipt no. for my spouse's H4 application?

October is usually a month where we see improvements as new visa numbers become available for a new fiscal year. Most categories showed forward movement though few jumps of more than a few months. The exception is the Mexico Family 1st category which jumps a year and a half. EB-3 is available again, but not set at a date particularly close. Most people will not be happy with the dates. Hello:
I am on L1A at present and my full 7 year term is expiring in DEC-2012. My company could not file EB1-Int'l Executive or manager due to ownership changes etc. But they are considering EB2 and I was told that it will be risky as I would be required to convert to H1B before that and I would lose one year of stay.
Can someone advise whether my company can apply for extension of my L1A beyond the 7 years, if it files for EB2 and would be pending for approval, instead of going through the issue of converting to H1B?

My I-140 has been approved and I-485 pending for more than 18 months. I have a valid EAD & AP. I also have a valid H1-B visa valid till 2011,

1. If I get laid-off, how long can I stay in US without another job?
2. I understand that in order to maintain my eligibility to "port" to a new employer / sponsor under AC21, I should have another job in same or similar occupation. Till I find another job, am I allowed to do some part-time job in different occupation?
3. If new employer gives me the option to move permanently to its subsidiary in another country, what are the available option for me to continue with green card processing?
4. If after going out of the country , I want to come back in future before Green card approval, what will be the available options?

As long as the labor cert. appeal is timely filed you should be able to extend for one more year.

prevailing wage calculations for EB-2 applications to be filed for Sr. Systems Analyst and Sr. Software Engineer. As of January 1, 2010, these wage requests have to be filed using US DOL�s electronic iCert system. For the past couple of years, the NJ DOL had given us LEVEL II wages for these positions. Now, US DOL is giving us LEVEL III wages for these positions which is at $102,274
EB-2 Software Engineer/Systems Analyst LEVEL III at $102,274 , or file under EB-2 ITPM LEVEL II at $116,501
I wanted to confirm whether these wage Calculations Declared by DOL are correct to file for EB2 category and do we need to quote such high salary ranges.I have master's degree plus 5+years of Experience in IT field.So, i will qualify for EB2 category but only wanted to confirm whether the wages declared by DOL were correct in respect to Jan 2010
Anyone or the concerned attorney can you please clarify on this.

Yes it will be cancelled.. If you go out of US and has to come on h4 then your h1B will cancel.
Check with attorney... Please think of contributing to fund drive.
