I am a US Citizen and just married an immigrant. Her situation is interesting. Upon arrival to the U.S. she was detained and an I275 was filled out but not submitted. Apparently, her visa had been expired due to an overstay in the distant past. The result of the detention was a Paroled status stamped on her pasport. No I-94
We met shortly after her entry and are currently maried. We want to self-file the I485/I130 papers but don't know how to proceed without an I94 number. If we submit an I102 will she get an I94 replacement or will they reduse based upon her Paroled status, whcih she has overstayed?
Please Help...

I was wondering about DOL letter which my employer received yesterday..for Recruitment process for 30 days..I wanted to know is it because of the conversion we did to RIR process some days back or is it just that they caught up with my TR application after 5 years..TR-Oct 2001

We filed our 485 on July 2nd 2007 at Nebraska office � EB3 � July 7, 2001
- The case was shifted to Texas and we received notices from Texas office with receipt date of August 27.
- Our date is now current however processing at Texas is still stuck at June 27, 2007.
- Does this mean our RD is now 08/27/07 even though it was recd. at Nebraska on 07/02/07??

As the article stated there are 47 million latinos and majority of them are citizens.....we don't have that kind of numbers to make an impact on either party.

Unless some political goof up turns, economy seems to be getting brighter and brighter. This might help translate into more jobs and opportunities..

We can see the uptrend beginning new year
Unless some political goof up turns, economy seems to be getting brighter and brighter. This might help translate into more jobs and opportunities..

My Parents have 10 yr visitor visa. They came to USA, stayed for 4 months and left in July 09. Now they want to come again in October 09 and stay for 6 months. Is it possible? Do they face any issues at POE? Gurus please give your valuable thoughts or experiences?

Hi Sukhpreet, are you sure the actual petition was filed and denied, or just the labor condition application (LCA) was denied? The LCA is one component of the H-1B petition; it requires a valid FEIN number, and it needs to be certified in order for the H-1B petition to be filed. Most likely, this is what has been denied because the DOL could not find/match the number. The lawyer can just refile the LCA with the appropriate IRS documentation, and it should be certified within a week. The H-1B petition can then be filed with the certified LCA.

This is for my wife. Her 485 is pending with TSC. PD is EB2 India March 15 2004. Has been current since September 1. After the USCIS website update recently received Document production or Oath Ceremony status update online. And message saying a document has been sent etc.
Since she was current we thought it might be good. 30 days later nothing received. Raised SR since we didnt receive anything. The customer service rep as usual didnt know anything. Said they haldn't received anything back. They opened SR. We got response 3 weeks later.
In the response letter it says that another notice will be forthcoming to tell you to go to local ASC.
Havent received anything. Do you think right now should I again pursue after them by writing to Ombudsman etc especially since case is current? Mainly I am afraid that since the status says Document production would some IO think that the case is already approved and so stop working on that case? Please advice. Thanks in advance.

The country's best known Hispanic GOP politician, Florida Senator Mel Martinez, announced this morning that he would not be returning to the Senate after the August recess ends.
