Consider a consultant-only company where all employee work on client projects and all got EAD and can change employer anytime they want. What happens if everyone leave the company after 180 days and you (and few other) still continue. As this will have great impact on company balance sheet how this may effect final GC approval of those still continue? Most of us will have to wait 3-4 years before we get GC approved. Can it cause any problem or RFE? Or I-140 approval must be enough to show that employer is able to support the employee after GC approval. Just a thought.

USCIS has informally advised AILA that it will prioritize the adjudication of H-1B change of status cases for F-1 cap-gap students who are otherwise prohibited from continuing employment after September 30. AILA Liaison has been coordinating with USCIS to help achieve this outcome. USCIS has the means to independently verify these cases.

If I have I140 approved and I have 3 year extention after my 6 years on H1B. Can I get H1B transferred to a new employer and then start my Labour all over again.

My company filed a new PERM application recently. I have a EB3 I-140 approved from my old employer ( Approved in August 2009). My attorney had filed the new PERM and requested to capture the same date. Will this cause any problems? Below is the question that is asked in ETA9089 form.
1. Are you seeking to utilize the filing date from a previously submitted application for Alien Employment Certification (ETA 750) ?

I am a Canadian in the "Approved I-140, waiting for 485 Limbo" status. I have a prority date of March, 2004. I find IV a good source of both information and encouragement and I would like to know there are others near me who feel the same. Hope to hear from you soon?

The big question is that why the so called "IV leadership" is not filling a FOIA request for how many EB3-I cases pending till date. Infact they should ask numbers for all the categories and their priority dates. It should be simple SQL query for USCIS.
This is such a burning issue and so many people are suffering from it. I still don't get it why would IV is not raising this issue... Can some one from leadership group respond please.......

Hi All,
I am purchasing tickets to INDIA in an hour. Haven't thought about this much until one of my friends asked me this. My priority date is March 2005. I am planning to travel to INDIA using AP in December last week and come back in first week of Feb 2010. IF my GC gets approved during my stay in INDIA, would it a problem while coming back or if an RFE is issued, would it be a problem.
Please advice

This reporter has got it right. The U.S. is obsessed with importing poverty from poor non-assimilated immigrants (mostly illegal) and shunning high-skilled immigrants who assimilate and increase the country's living standards. The New York Times carried on its front page this morning a Nina Bernstein article that will no doubt cause a shake up at Immigration and Customs Enforcement over what can only be described as a major scandal in the way the agency has dealt with sick detainees at the agency's detention facilities around the country. The details described by Bernstein will no doubt enrage you. The obvious monumental effort Ms. Bernstein put in to bringing this story will also likely move her on to the short list for a Pulitzer Prize for this hard-hitting piece of journalism.

Such an action would be illegal, but CIS has already stopped accepting I- 485 applications for another category known as "Other Workers," despite June Visa Bulletin showing that category is current. My advice to all of you is keep filing all through the month of July. For all we know, they may never issue such an illegal policy or they might lose a lawsuit filed against them. So keep filing.

There is no relation between your first FP and FIrst EAD.
Your EAD card will come the message ' FP not available."
Sequence is fine...you should get your card in mail anytime now.
