    Today , an officer from Homeland Security visited my office.
    The guy showed his Identity Card and was looking for me and the my boss (who signed the Visa Papers). He took me privately in a conference room and asked me questions like my pay, my duties, who paid for H-1 renewal etc.
    Then he went to our HR dept and asked a few questions regarding my employment history. He asked me if you are treated well in this company. ( Note: Mine is not a consultant company) Anyways the guy was very polite and he told me its just a formality from homeland security
    also he took picture of my desk

This reflects an increase of 100 cases from the prior count, provided on August 14, 2009. The advanced-degree cap remains at 20,000. The USCIS continues to accept FY2010 H1B cases under the advanced-degree and regular caps.

    We suggest to US employers to file H-1B Petitions only if they can able to provide the Client details like Letter from the end-client, Work-orders confirming the placement. If you are having an in-house requirement, provide USCIS with ample proof of your in-house requirements. Considering the flood of H-1B RFEs, we have to be bit cautious in filing works. The standard approach prevailing until last year needs a re-look. Be assured, if you are right on papers and abide the Immigration requirement, you will for sure come with flying colors.     Dear Attorney,

    I am a July 2007 I-485 filer. Have an EAD but primarily working on H1B full-time as a Systems Analyst. I am a Certified Fitness Trainer but not sure if I can use my EAD to work as a Fitness Trainer in a local Gym (part-time).

    Any advise will be much appreciated.

    Hi,

    Some where in May I heard the news that end of this year USCIS is going to halt concurrent filing of I-140 and I485 and introduce an extra step called preApp of I485 which can be done only after an I40 approval. I would like to know if this is really going to happen?

    I have an approved I140 and a PD of Apr 08. I am planning to change the company now. My doubts are
    1) Suppose if USCIS changes rules and introduce an extra step for preapp of I485.
    What will happen if I switch company after 180 days of preapp of 485. can I invoke Ac21 ?
    2) will I be eligible for EAD/Parole after preapp of 485?

    Any body having any knowledge about this please share.

    Hi,
    The I-485 case of mine, my wife and son was approved on Aug 5 2010. My case is EB2 and priority date is Jan 2006. When I enquired USCIS 2 weeks back on not receiving the physical cards for us yet, we got a reply mail for all of us that USCIS is waiting for our biometrics. Why is a biometrics needed after I-485 is approved? Me and my wife gave our biometrics last September only.
    We are not sure when we will receive our biometrics notice and how long will it take to get our physical cards after that? Please guide me on this.

    I was H1B, but used AP return to the U.S. the same company, but when I filed the new I-9 form after return, the company lawyer asked me to write EAD and EAD expiration date, so I guess I am AOS now? or not? I am not sure. My company will resume my H1B this month, but don't know when it will be completed.

    Now I am going to e-file EAD renew.There are some questions in the form I-765 that I am not sure how to answer (The lawyer has completed his 140 and 485 document, so he doesn't want to answer now.):

    1, Manner of Last Entry into the U.S.: Should I choose PAR (PAROLEE) or H1B (SPECIALITY OCCUPATION)?

    2, Status: Should I choose PAR (PAROLEE) or H1B(SPECIALITY OCCUPATION)?


    3, Please select your eligibility status : Should I choose (a) (4) PAROLEE or (c) (9) FILED I-485?

    Hi all.
    I just came back from Canada after 4 days using 30 day rule as I wanted to recoup few days so that my co. can apply for 7th year extension because my LC shall be pending for more than 365 days. My question is does my employer have to file two seperate LCAs for each I-129 application or same LCA copy can be attached with each I-129 ( 1st I-129 for extension for 3 days, 2nd I-129 for 1 year extension ) ?
    ( NOTE- MY I-94 WAS EXPIRING ON 15TH MAY AND LABOR CERT. SHALL BE PENDING FOR MORE THAN 365 DAYS ON 17TH MAY, SO I HAD TO TRAVEL OUTSIDE USA TO RECOUP FEW DAYS)

    Today I rceived someone else's EAD. We received three EADs, one each for me and my wife and another adressed to me with EAD inside being some one else's.
    Weired ways of USCIS!!!!

    I shall call USCIS and notify them of this.
