I received RFE letter from USCIS for missing TB skin test result in the medical reports.I took TB skin test in 2007 and came out negative. Here is the test of RFE
"your application contained form I-693 in which the required TB skin test was not conducted. Please note there may be conflicting information on some published form I-693 instructions regarding when the chest X ray Report should be performed. It is required only when the TB skin test indicates a reaction equal to greater than 5 mm, or when the reason for why the TB skin test is medically inappropriate to perform has been annotated on theform I-693. Please submit a newly completed form I-693 indicating the results of the required skin test."
After consulting the doctor concerned, she filled up new I-693 form with 2007 test results and provide me I-69e form in a sealed envelop. Can you please let me know whether 2007 TB skin test results will be acceptible to USCIS or do I need to do another TB skin test? Please Help.

Hi Gurus,
Request your help on my query. I am on H1B with an I 797 valid upto 29-Jan-2011 and dependants have stamped H4 visas valid upto 29-Jan-2011. My company is in the process of applying for my H1B extension (this will be my second extension and i have currently completed 4 yrs 9 months in US).
My dependants are planning to travel to India at the end of this month and plan to return back by end of Nov. Will they face any issues during their return at POE ?
Will there be any complications with our visa extensions ?
Appreciate your response at the earliest.
Thanks,
Kish

Folks,
My congressman's office came back with this response for my query on why my wife's case is pending..not even pre-adjudicated, while I got approved on Sept 3rd from TSC.
according to TSC, your file and your wifes were separated at time of adjudication and that is what has caused the delay. Im trying to find out why.
Anything like this happened to anyone. Is there anything that can be done, to recombine the cases. My attorney is not very responsive since he was with my last employer. What are my options? I am worried her case is falling thru the cracks. Without any information on the principal applicant and derivative's case may never get adjudicated.....

Dear Attorney,
Below are my details:
Current work status : H1B
Applied for I-485 , July'07 filer, priority date: jun EB3 category
My husband details:
Current work status : H1B
Applied for I-485 , July'07 filer, priority date: Feb EB3 category
We both have separate EADs and H1B visas and are independent of each other currently.
Because my priority date is 2006 and my husband's is in 2005, there is more possibility that he may get GC before my PD becomes current.
When my husband's priority date becomes current, he wants to file it for me again so i would get GC along with him.
I am now considering to look out for jobs and use my EAD card with new employer.
Can I make my EAD active ? Will it cause any problems when my husband's priority date becomes current and when we file my application along with his ?
Any input is greatly appreciated.
Thanks.

My country of citizenship is Canada and currently working on TN status. Canada is covered under Visa waiver program so, I don't need to get visa stamping but need to travel through a POE so, I could get new I-94 for the H validity period.
In the I-129, I have opted for Calgary as POE, but due to some reasons now I have to travel via Toronto, would that be ok?

Depends....
Does the husband has a pending LC / I140 / I485? If yes, the dates matters.
What was the reason for denial of his H1?
My friend is on H1 and her husband's H1 extension denied after 6 th year. Can she add her husband to her H1?
Can a person stay in USA on H category continuosly more than 6 year??
Please respond immediately

While some may find it a slight to the big picture to discuss the plight of a laid-off H-1B worker (given the relatively small percentage of such workers when compared with the unemployment rate of all U.S. workers), its worth taking a glimpse at the unique circumstances confronting such an H-1B worker and his/her family upon receiving notice of termination from employment. Especially since this dilemma, unlike most others, has a simple fixa regulatory grace period. The underlying problem is that employers rarely give ample notice in circumstances involving a reduction in force. Instead, a two week severance is commonly...

Folks,
I am on my 6th year of H1B. My current H1 expires mid August 2009.
My PERM was filed in May 2008 and was approved in Dec 2008.
My I-140 is applied and pending. I work for an american consulting company.
Naturally, I dont have an EAD as yet.
Based on my PERM approval and 365 day rule, I know I can extend my current H1 for 1 year.
(planning to do this ASAP).
Here is my question:
- My current client contract will get terminated soon. If my current GC sponsoring company decides to terminate my employment (due to project non-availability), can i transfer my extended H1B to another employer?
In other words, is an extension H1 (7th year and beyond) similar to regular H1 (first 6 years) in regards to invoke the "transfer" rule between eligible employers? or is it tied to GC sponsoring employer?
- By doing so, do I abandon my GC application (i think i will, but general clarification) ?
Any advise would be greatly appreciated,
LT

Hi ,
Parents are here on Visitor Visa, want to travel to Canada via Road (Toronto),
Is the process still the same -
The I-94 gets submitted before they leave US.
New I-94 while entering.
The new I-94 would have the same date of departure as was in the previous I -94 ?
Thanks in Advance.
P.S. Not travelling to get an extended time of stay in US.

If your old visa has not beenexpired at the time of re-entering . You will need to carry your new approved I-797. But your I-94 would have the expiration date as that of the expiration date as on your old Visa.
I had the same situation last year and the processing went smoothly at port of entry, but you may check for any chages in the regulations.

Eleven people arrested in a scheme that raked in an estimated $50,000,000. Here are details from the LA Times: Authorities arrested 11 people Monday in an alleged U.S. work-visa scam that raked in more than $50 million from thousands of Brazilians since 2002. Some of those scammed went to the U.S. and wound up as illegal aliens because promised jobs didn't exist. Brazilians seeking temporary working visas were charged up to $15,000 each in what a statement from the U.S. Consulate called one of the largest cases of U.S. visa fraud ever. Similar schemes were uncovered in Russia, the Dominican...
