Hellow,
I have a quick question. My I140 got approved in sep'08. Should I have to wait till PD gets current or I can file for I485 and USCIS will process my application according to my PD?

Any responce will be highly appreciated.

I have a question; my girlfriend came to the US with a tourist visa in 2002 (now her visa is expired), so now I guess she is an ilegal alien, my question is: Is there anyway she can become a legal resident?

You probably could BUT sooner you try contacting a lawyer the better you are...good luck

I'm going to guess that the same folks in the Tea Party screaming about the deficit will somehow find this breaking news to be irrelevant. I am Aug 07 filer , I was not able to submit my medicals with my I-485 application .

I got my medicals done with civil surgeon in sept 2007 and was waiting for RFE to submit the sealed cover . I never got a RFE but I got a interview at local office next month .

So can I submit the sealed cover that the civil surgeon filled in 2007 or do I need to get all the tests done again now and fill a new form .

AFAIK, the medical test date should be within 3 months old. You should check the USCIS website to confirm.

We are family of four and have the following status

Self - Adjustment of Status (AOS - 485 filed in July'07), AP, EAD and a valid H1 (renewed recently)
Spouse - AOS 485 (filed in July'07), AP, EAD, H4 expired end of April 2010
Son 14 yrs. old - AOS 485 (filed in July'07), AP, H4 expired end of April 2010
Daughter - 11 yrs old - AOS 485 (filed in July'07), AP, H4 expired end of April 2010

Does my family have valid status? Specially my kids since they don't have EAD. Shall I renew their H4 for valid status? I was in the impression that if 485 is filed then there is no need to renew H4. Please advice me. I am totally confused.

Hello Everyone,

I need some suggestions from you guys.

My Employer A filed my green card labor in April 2000.

I was working with them on H1B till May 2003.

I moved to Employer B on H1B in May 2003.

Employer A continued to process my GC, and they filed my I485 in Jan 2007. I paid for the expenses.

My I485 is now pending at TSC.

Also Employer A confirmed they will support till i get my GC and I don�t have to work for them.

Can I use AC21 portability to move to another employer C using my EAD?

Do you see any issues i may face since i am not working for employer A?

i got married with my husband right before he filed his i-485, so we can file it together. His i-485 recently got approved, mine is still pending since March 2007. After speaking with IO, I found out that my name check is pending. My name is not common, I had no interaction with a law agencies in any way. So, I suspect that name check is just an excuse.
My question is, can my marriage to my husband just before i-485 filing be a reason I am still waiting? Has anybody experienced something like this? I'm not from a country where arranged marriages are common practice and we have a child together.

Hello, My parents on B1 visa just entered the US a few days ago. This is their 2nd visit. I extended their stay beyond the given 6 months when they came last time. My mother got a 6 months term on her I-94 this time which is ok but my dad was granted only 60 days of entry and he said the immigration officer has marked in Black marker pen saying "No Extention" on his I-94 card. The justification they gave was that they were unable to find his previous extension, but if they were unable to find his extension, how could they even permit his entry in the first place since overstaying without extension would be illegal.

My question is with "No extionsion" marked in writing on my father's I-94, could I apply for his extension beyond the granted 60 days?

Please answer this question so that I can take the needed action.

Hi,

I am GC holder & right now I am living out side USA with my husbad whom I am married for more than 8 yrs. I have 2 kids, they are US citizen. I visit my parents (US Citizen) every year to US for couple of months & come back. In past my husband tried for US visitor visa few times but he was denied. Is there any way I can apply for my husnad a non immigrant VISA from US for a visit? As we would not like to migrate to US but just to visit there. Is there any way or I have to apply for him immigrant visa only & wait for 5-7 yrs.?

Please guide.

The couple applied for the green card together. The husband applied under the EB1 category and his wife also applied with him as dependent. The green card of the couple has been approved and is expected to arrive in a month's time. The wife is not in US currently. She is outside US. Will the husband get his green card & the wife's green card in his wife's absence? Will there be any complications in the husband's green card in this case?

It is urgent. Please reply as soon as possible.

Hi Gurus

My I-140 petition was denied 2 months back and My attorney is trying to re apply for it. In the mean while there is a query on the company it self and our attorney is working hard to get it cleared.

In the mean while I am thinking about switch the employer.

I am in 8 th year extension and My VIsa is valid until jan 2008.

1.Assuming some comany offered me to apply for I140 and 485 and join that the company, what will happen If I140 has not been cleared before Jan 2008?.

2.What are the pros and cons I should think about when I switch the company.?

Folks,

Here's one question I have which I haven't see in any forums so far (perhaps its lurking somewhere .. who knows) ... let me get to the point.

When filing for AOS/485, if the I-140 that was filed prior to filing AOS was pending and gets approved AFTER 485 was filed... should we explicitly inform USCIS that that 140 was appoved ?

I guess USCIS should have that information (of course!) but I am not sure if we should be pro-active and make sure we inform the service center that the 140 was approved ?!

Hi,

My Priority date is Jun 2006/EB2 India. After the Aug bulletin I'm now afraid that my priority date might get current next month.

My concern is that I might be getting married in the near future and I don't want to deal with an immigration nightmare for my spouse. At the same time I don't want to rush a decision like getting married based on USCIS priority dates. Is there anyway I could delay my GC adjudication for 3-4 months to get some more time ...
