Hi All,
My wife is currently working on H1B. She recently got her EAD through my GC application (I am the primary applicant). Can she use her EAD to work for her current company who is holding H1B?

Hi,
I have an approved I-140 with my current employer. I have an offer from another employer that I am considering but the new employer will only transfer the H1B and not sponsor the GC.
Q1: Can I transfer my visa and start working for new employer and keep the GC process with the old employer if they agree to keep the offer open?
Q2: After visa transfer, if my PD becomes current, can I file I-485 with the old employer while working for the new employer?
I really appreciate any help.

Thanks a lot. This is more in depth and I am not understood how these things work.
So if I have MS+ 0 then I think I have to post my ad for JobZone 5. In that case, my SVP will be 7 because MS = 4 yrs and 0 expr = nothing. So i will not exceed SVP 7.
So is the combination,
JobZone 5 with an SVP 7 will work for MS+0 ?
Also for a software developer or related work, i don't see JobZone5. What kind of positions suit for JobZone 5 in SOFTWARE DEVELOPER'S world ?
Anybody know about these things ? please drop in your thoughts

On October 30, 2009, the USCIS announced that 53,800 of 65,000 regular cap petitions have been received. In addition, approximately 20,000 U.S. Master's or higher petitions (i.e. advanced degree petitions) have been received. Any advanced degree petitions received from here...

I have a work related travel (2 days max) coming up in January. Do I need a canadian visa. I am on AP and my US visa on my passport has expired. My H1 is valid till 2009 (not stamped on the passport).
My question is Do I need a canadian visa? Let me know if anyone had a similar experience.

No more interim EAD at Infopass since Sept 2006.
If it's an emergency like loss of job offer etc. you can take a cover letter with your receipt notice to Infopass and they can fax it to the Service Center for expedited service. Alternatively you can fax it yourself.
The decision whether to expedite your case rests with the Service Center.
Also I would say hang on for a few days if possible. I got my EAD approval e-mail after 101 days since RD from NSC.

I called USCIS and checked about it. The officer said that she shoul dnot have applied online and made the payment. She should have sent paper application only. And that there was no need to pay any fee. He said that the amount once paid to USCIS can not be refunded back. Ridiculous.

I have a rather simple question to ask. I came to the US on a J2 visa with my wife who entered a Ph.D. program. Last year I was accepted into the same program, starting this fall. I didn't change my J2 to J1 because I was waiting for a TAship job offer that would grant me a fee waiver.
Now we're back in the States and there is an on-campus job opportunity that would grant me a fee waiver. I am considering either a) staying on J2 but getting a work permit or b) changing my status to J1.
What I'd like to know is, can I sign a contract with an on-campus employer and start working while my J1 change is being processed? It doesn't really matter much if this means that my paychecks will be delayed; like I said, I would welcome the opportunity to get the fee waiver.

My wife's labor has been stuck for 2 years ( she got an RFE ). Her company lawyers arent too helpful and asked us to just wait. Wanted to know, what steps one can take to try to figure out what is happening.

Now that USCIS has dropped bomb by announcing the revised bulletin, do you think now they will be able to bring back the premium processing for I-140? or still they dont have time to "ensure" processing in 15 days.
