    My friend John Lamb is an in house corporate lawyer by day and an immigration reform activist in his spare time. Maybe the fact that he's outside the immigration law world gives him some room for thinking outside the box since he's often coming up with creative approaches to changing immigration law.     I am silent visitor of this forum for last few months though, I seek some advice form you guys in forum. I just got I140(On May 5th 2008) approved and my priority date 23rd Jan 2004. As per the visa current bulletin I am with in the cutoff dates. I have job offer but I did not accept so far because I 140 was not approved but after I 140 I thought of changing the job (same offer) using AC21 portability, since I fall in current cutoff dates,


    My question is this safe to change the job when priority date fall with in current cutoff dates?

    GOT RFE on I 140 on Apri 1st 2008
    RFE relied on MAY 1st 2008
    I 140 aproved on May 05 2008
    PD is 23 Jan 2004

    In compliance with the precautionary measures and the travel health warning issued by the Department of State, the U.S. Consulate in Ciudad Juarez is canceling all immigrant visa and waiver appointments from April 30, 2009, through May 8, 2009. Individuals with immigrant visa appointments scheduled during this time will receive a letter with the rescheduled appointment date. Individuals with a scheduled waiver appointment will be contacted via e-mail or phone regarding the rescheduling.

    By the ways, there is also a possibility to request retaining old priority date, without filing a second 485.

    I assume this is just a request letter from attorney or any representative, if they didn't act on it follow-up with a Service Request.

    Below are the 2 listed jobs.. I am currently working as ABC for XXX comp... I have been working for more than 3 years.. They are planning to file my GC soon..

    I know for a fact that you cannot count current employer exp for GC. If i start working for the same employer on XYZ is it more than 50% different in role so i can count my 3 years experience when applying my GC ??

    My attorney sent my I-485 at Nebraska center because my I-140 was pending at Nebraska but according to question # 38 on FAQ-3, it should have gone to TX based on June 22, 2007 direct filing directives. Should I file again at Texas center?

Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed.     Hey

    I am in a weird situation. My spouse would be graduating from business school soon ( summer). I want my parents and my aunt & her daughter to attend the graduation ceremony. My parents have an appointment coming up this week for visa (Hyderabad consulate).
    For my aunt (37 yrs - house wife, husband passed away recently) and cousin ( 14 yrs - attending school), is it wise for me to send visa papers? I am a PR. My aunt has son who just finished 12th class and waiting for admission letters from graduate schools in India.
    Can he be included in the papers for visitors visa? Or is it risky for him to attend now?

    They have a set of sponsor papers from her sibling who is a citizen. those papers include all three of them (son, daughter and mother).
    is it possible for only 2 of them to attend( mother and daughter only) while the I-134 mentions all three of them?

    Is there any way out of this?

    the LCA needs to be done for any H1B or when the job is in a new location. it doesn't take long to get that submitted (<1 day) no need to go stamping. it doesn't cost any money to submit a new LCA

    I am happy to write that today I received my first emailed receipt notice for a FY 2010 H-1B application and that then, about 5 hours later, I received an emailed approval notice in the same case. The I-129 was a U.S. Masters Cap case that was premiumed processed with the Vermont Service Center.

    I will update this site as I receive word on my other FY 2010 H-1B cap cases.
