Hello VayuMahesh: Congratulations on getting greened.

My EB2 140 got approved more than 10 days ago, with old EB3 priority date on the approval letter (and my old A number), but still no LUD on my existing 485s.

Do I need to do anything to get it moving? How do I put a Service Request on 485? The online system to put an eRequest only lets you do it for N400 or I90.

    Thanks in advance.

Lot of weird things. Still waiting for 485 approval even after sending interfiling request in mid-November. My attorney has sent an email reminder again 2 weeks back. Even for the I-140 which was approved in November 1st week, online status still says "Initial Review".

Opened a Service Request early this week and received a reply with the status as follows.

Thank you for contacting us about this case. According to our systems this petition was approved and it has been sent to production. Your case will be processed in order based on the approval date. If you do not receive the document within 30 days feel free to contact us again.

Online/Phone status is still processing .... I have to just wait and see I guess.

what happens when dates retrogress? If my PD is 2000 Jan (assume) and some one else has 2001 Jan (assume) with RDs July/2007 and Mar/2007 respectively and in August 2007 PD cut off date went back to 2000 Feb (assume) then does it mean that 2000 Jan PD is ineligible to get the adjudication before the guy with PD 2001 Jan because the RD is later for this case? Again if the answer to this question is yes then ,when the PD is set at 2000 Feb why are they accepting new AOS apps which satisfy this PD cutoff date because if they process by RD(at all times) they are not likely to consider these for adjudication anyway? Is it just for our benifit that we can get an EAD? If I go down this path I donot understand the purpose of the whole PD in this process.

The thing I am trying to understand is 'if PD is not significant in AOS why is it there at all in the visa bulletin'. If RD overrides the PD at the AOS stage then instead of specifying a PD in the Visa bulletin they can just say that

"We are accepting new AOS applications" and then adjudicate them in the order of the RD.

These are all just my thoughts and am trying to put them together. I may very well be wrong in my basic understanding of this process. Thank you for your previous reply. That was helpful.

In your case you will get the percedence over the 2000 PD. His is PD is not curent at time of processing. If the cut off date is after 2001 which means both are cuurent then the later guy will take precedence since his RD is earlier than your's.

H1B petition can be revoked automatically if a) employer notifies USCIS that the petition is withdrawn or b) employer goes out of business. See 8 CFR 214.2.(b)(11). So yes, EAD is much safer in this regard. Revoked H1B petition cannot be used for transfer/extension. It's nice to have H1B as a fallback, but it's not a safe heaven.
Here is an interesting article regarding H1B and employer's obligation to notify the USCIS if employment ends.
    http://www.chincurtis.com/pdfs/ccid_1_033007-1.pdf

Which means that EAD is much safer than H1b. Then why are Attorneys insisting on the opposite (H1b against EAD?)

If this is confirmed news, i will revisit my blog and make changes

    Folks,

I'm on H1 and my wife is on H4. We have both got our EADs and have visa stamps till Jun 2010.

Can my wife switch to the EAD status and start working even though I remain on H1 status till my visa expiry? Is this allowed?

If yes, then can she travel on AP while I'm still on H1 visa?

If we're both re-entering the US, can the IO ask why is the spouse on EAD/AP and not the primary applicant?

    Thank you very much!

IV Core any ideas. Will this work.

    .....
some 50-100 EB3 I applicants should go to DC and meet high officials, CHC folks and every department that is influential to EB immigrant VISA and make them understand our plight. No guarantee that this would work. But, we will get a first hand response that may help atleast help us to chose from one of 3 options listed above.

At least I won't give u red dots if you can enlighten us how to get us out of this mess. And yes, we do want our green card so I don't think we can stop the process or stop spending money on that. Also please advise us how to bring all 70K people under one umbrella?
I dont mind getting Red Dots, But please, for god's sake. Stop doing this fruitless campaign. Do you guys think Giving a Clock or sending flowers solved earlier problems. Enough of this Gandhiian ways. This country is not good for people like Gandhi. May be Flower campaign got noticed and created a whole new experience for the USCIS, but i dont think it really helped them do anything in our favor. Already, folks here are wasting their money, year after year, on their EADs and APs for them and their family. Just think for a second guys, It costs us 1000 $ to maintain status on AOS and visit our family and this is going on indefinitely for our years now. USCIS/Congress does not want to do anything about this, They are happy to get the revenue. Even if you think a minimum of 200,000 people spending 1000 $ an year, it is 200,000,000 $. Iam not even considering the amount they spent on other things like H1B extension, H4s..... Just think about the Dollars they are making on this Green Card SCAM. Accept it or not, it is indirectly affecting our lives, even though, GC is not really important for lot of folks. Iam one such person, I have a good client and a decent employer and iam with the same folks for 9 years and they are happy extending my H1b at their cost. But still, this whole GC game, is sometimes disturbing. They are playing with our emotions and our loved ones. So, GUYS we need to take a bigger and bolder step. To me, Calling people, sending flowers and letters explaining the situation makes no sense. Do you think, those guys dont really know about our situation. Let us a make a bold move. We are 70,000 folks just here in ImmigrationVoice. Let us compile a letter, that pushes USCIS/Congress on improving the condition. As long as they get those EXTRA Dollars, i dont think anything is going to happen. Even if they remove the provision to apply for GC while on H1B, it is good for us, for we will know that in advance and can plan on shaping our future better, instead of this false promise and emotional torture. I think even AILA or other Lawyers are useless. They dont want to do anything for us. All they do is, interpret the LAW , and explain us in the way we can understand. They dont take steps to fight for the justice. All they care is the money. So let us make our point clear to USCIS, we dont want to waste money on EADs and APs and H1B extensions. To me, it should be free of cost, since it is their problem that they dont work efficiently. Why should we pay 1000s of dollars for their inefficiency. let us all 70,000 work together in sending a letter to USCIS or Congress that We are not willing to spend any more money on the GC knowing that we are not going to get it anyway. Unless, we do something like this, the real impact of our situation will never get noticed. Again, our main aim should be to let them know about our situation and not just that IV is a group that will send flowers, to express its presence.

America is losing its attractiveness to the worlds top talent. Those of us in the system may feel that having invested so much time/effort/money already in the process, we cannot turn back now and cut our losses, however looking at it from the perspective of a promising 24 yr old researcher or graduate, the vantage point can be quite different. He has very little invested in this country and looks at the situation of those like us ahead of him/her in the pipeline to make a decision.
That decision might become that the US is not a place to settle down, that it is not a welcoming nation, that opportunities are choked off for the non natives, etc etc. Those would be the worst messages to send to the cream of the world's talent. The reaction would be to either not come in or to come in with a mindset to take the best of the education system etc and move on to the best opportunities. The US has never had to react to his type of thing, because hitherto it was a minimal issue. The current policies however are changing that.

Dude, easy, take care of your heart, you might get a heartattack.

They have processed millions of applications and GCs already.

I am as frustrated as you are, but I am sure they have a system and management in place. Call it crappy or not.

Their objective is to provide service to the customers, we are their customers, we are giving them exorbitent amount of money as fees. I don't know of any other Organization/Company who provides as crappy service as they do, what would you call their management then ???

We stood in the backlog queue. 3 years. 4 years. Now, we are standing in the I-485 adjustment of status (to apply) queue.

Neither the USCIS nor anyone else have real hard numbers of how many are in each in queue. So, what makes you think that you will NOT be stranded again, like us, in the latter queue. Let me tell you; things are not pretty. PERM has eased or will ease LCs and backlogs. The attempt at IV will help folks affected by retrogression take less years to apply for I-485.

I dont expect the wait to be any less longer .. But I would surely welcome priority date being based on H1 start date as it would be more fair method

Everyone passes this stage. I was in the same boat sometime back and I did not think about applying for greencard.

When I reached 4.5years in my H1, my debts were not decreased. Infact it increased as I invested in India and in some tangile properties in US. So I thought I should stay here for more time to clear those debts. To stay for more time, I needed this stupid GC. It was needed atleast to extend my H1 to start with.

So my piece of advice for you is to start this process as it is not going to hurt you when you are mentally prepared to leave US. If you get it, it is good. If you dont get it, you have nothing to lose. At least you will the option to extend your H1 if you decide to stay for more time.

I am one of those guys who entered US in a very late age (I am 35 now...) and haven't even started the Green Card process yet. I wonder everyday "if" and when the process gets started..how many years it would take to get GC (may be 5 to 6 years..correct me if I am wrong)...and after getting the GC..wait for another 5+ years to get Citizenship...I will be close to 50...ouch

Well, as of today I don't feel like applying for GC...I realized my dream of coming and working in US...now the plan is to spend 4 to 5 years, clear my debts (yeah......running into thousands of dollars)...make some money to live peacefully in India..thats it....then go back to India....

And its not just the family or friends...95% of my cousins and 90% of my friends are in US (trust me it is a large number)..except for parents and in-laws (and uncles, aunts)...every one is here...but I hardly get a chance to meet them...b'cos no one wants to take some time off to meet cousins/friends (unless you are in drivable distance)..I don't blame them (or me)..since we all want to save our PTO to visit India....

I just wish..if I can spin the time wheel back...I would never think of a foreign country....(even though I am new to US..I spent about 8 years abroad in other countries already)..

I don't feel like concluding..hence leaving this incomplete...

    thanks for reading

    Folks,

IV is working to address issues that affect us now/sooner or later, please contribute as and when possible without waiting for any specific agenda to be picked up.

    Help IV to help you

Thanks to IV for that ..

But the word "later" seems to be very distant, not just for us. but for the dependents too
I believe this is administrative fix at least pre filing . This is more acheivable

    What does this statement mean?

    http://www.uscis.gov/files/pressrelease/ReceiptingTimes06Jul07.pdf

per existing policies and procedures, requests for Premium Processing Service will continue to be processed within 15 days. USCIS wishes to assure all customers that the original received date (the date which the document is date stamped) will be honored and recorded on the receipt notice. This date will appear in the "Received Date" box on Form I-797, Notice of Action. The received date is different from the "Notice Date", which also appears on Form I-797. The Notice Date is the date the receipt notice was actually generated.

Why USCIS suddenly did this press release? Something fishy?

If the system is flawed, any effort to work it out to get things done would seem incompetent and inefficient. First off, this guessing game by USCIS of estimating visa applications and asking for visa numbers from DHS is so neondartal and ridiculous.

Process must be automated and centralized to eliminate any human intervention in performing guesstimates. A pool of visas must be made available in the system and must remain available for the next year to be carried over if needs be. That would eliminate pressure on officials to play the game in the dark and rush like maniacs at the end of the fiscal year to catch frogs!

With all the revenue and system they have, do you think this is so tough to streamline? I doubt.

They can, at the minimum, have the cases in sequence, process per FIFO, control PD movements logically. The minimum they can do, easily.

I'm telling them my condition, and I know there are lot of people in the same boat. Again you need to talk to the lawyer about GC cost. Emplyee can bear all the GC related cost.
    EAD/AP 360*2 + 305*3(Spouse + son) is almost 2K.
If your facts are different put that in writing and send it to them. Please stop telling me my facts. Also I have no idea why you are on this thread, please ignore this thread if it doesn't apply to you...

    Desi3933

I don't understand why you are picking up on facts and faults on other post. What mirage is saying is true.I know 3 families stuck up in this GC process...all true cases.

There are some lucky people who have bought old labor substiution ;)who came to US in 2004 and got their GC's cleared and are very :D.

Some really who have come here to study...living in US for past 10 years genuine appliers are really stuck in this. They have all applied their labor and got them cleared only dec 2006.

people who are interested can send those letters if not ignore the thread.

If you are EB2 good for you...Its not that easy to change jobs having families..and when you are satisfied with the employer ,why would they change.

Everyone here want GC to stay in this country. And we all are here to find solutions thru IV - active participation is better.

Pani's letter is not that bad...if you dont like alter what you want to express and send it.People can write what they are facing only.

this is not an argument...just felt bad when you were point blankly picking on them.

    I dont undestand

But one thing I understand there are many , in general like to irritate and hurt other's sentiments and thoughts and pinpoint only faults.

Becoz of this lack of unity only ,most of us face problems.

    Hi

BOA is now asking me for I-94. In my I-94 it is stamped as"Paroled until July 29th 2010" - will they interpret this as my valid stay in the US being only till July 29th? Not sure how I can explain this to them

    Chandana
    Chandsri,

Do not worry, that is one of their procedures. They just go by the rules and documentation set by the underwritter. If you have your valid EAD and explain to them that you are currently on AOS status then it should be fine. If they said that we can not provide your loan because your I-94 is expiring soon, then just let me know and I will send you the loan officer's contact name that I dealt with.

I am EB3-India with PD of August 2003. I am anticipating at least another 2 years. Any forward movement in any category is good news to me.

Yeah I am EB3 India June 2003 too. Not sure when our turn will come, IF at all the way things are crawling here. Sometimes I really feel there is no justice to some of the IV members on here. I wonder which is worse, the corruption in India or the bureaucracy in the USA. Atleast in India, if I would have bribed the official, I would have had the documents by now.
